(i) societatea DELIA LEBADA SRL., o Societate organizată și care funcționează conform legilor din România, cu sediul social in Bucuresti, sector 2, str. Judetului, nr. 1, etaj 1, ap. 103, fiind inregistrata la Registrul Comertului cu nr. J40/11282/2016, avand cod unic de inregistrare 36458360, (denumită în continuare „Societatea”);
prelucrează date cu caracter personal în scopuri legitime, cu respectarea prevederilor legale şi a principiilor menţionate în continuare.
Prelucrarea datelor cu caracter personal se realizează prin mijloace mixte (manuale şi automate), în condiţii care să asigure securitatea, confidenţialitatea şi respectarea drepturilor persoanelor vizate.

1. DEFINIȚII
Termenii cu literă mare utilizați în prezenta Politică sunt definiți după cum urmează:
Consimțământ - înseamnă orice manifestare de voință liberă, specifică, informată și lipsită de ambiguitate a persoanei vizate prin care aceasta acceptă, printr-o declarație sau printr-o acțiune fără echivoc, ca datele cu caracter personal care o privesc să fie prelucrate;
Date cu caracter personal – orice informații referitoare la o persoană fizică identificată sau identificabilă;
Prelucrarea datelor cu caracter personal – orice operațiune sau set de operațiuni care se efectuează asupra datelor cu caracter personal, prin mijloace automate sau neautomate, cum ar fi colectarea, înregistrarea, organizarea, stocarea, adaptarea ori modificarea, extragerea, consultarea, utilizarea, dezvăluirea către terți prin transmitere, diseminare sau în orice alt mod, alăturarea ori combinarea, blocarea, ștergerea sau distrugerea;

Operator – orice persoană fizică sau juridică, de drept privat ori de drept public, inclusiv autorităţile publice, instituţiile şi structurile teritoriale ale acestora, care stabileşte scopul şi mijloacele de prelucrare a datelor cu caracter personal;
Terț– orice persoană fizică sau juridică, de drept privat ori de drept public, inclusiv autorităţile publice, instituţiile şi structurile teritoriale ale acestora, alta decât persoana vizată, Operatorul ori persoana împuternicită sau persoanele care, sub autoritatea directă a Operatorului sau a persoanei împuternicite, sunt autorizate să prelucreze date;
Persoană vizată - persoana fizică ale cărei date cu caracter personal sunt prelucrate.

2. SCOPUL PRELUCRĂRII DATELOR CU CARACTER PERSONAL
2.1. Societatea își desfășoară activitatea principală în domeniul lucrărilor de construcții a clădirilor rezidențiale și nerezidențiale.
2.2. În scopul desfășurării activității menționate la art. 2.1 de mai sus, precum și pentru îndeplinirea obligațiilor și exercitarea unor drepturilor specifice ale Societății sau ale persoanelor vizate în domeniul ocupării forței de muncă și al securității sociale și protecției sociale, precum și pentru asigurarea securității vieții și a integrității fizice a personalului care își desfășoară activitatea în cadrul Societății, precum și pentru protecția bunurilor din patrimoniul său, dar si pentru securitatea datelor Clientilor sau potentialilir clienti Societatea Prelucrează date cu caracter personal.
2.3. Datele cu caracter personal sunt Prelucrate numai în conformitate cu legislația europeană și națională aplicabilă, cu stricta respectare a termenilor și condițiilor specificate prin prezenta Politică de securitate.


4. PRINCIPII ALE PRELUCRĂRII DATELOR CU CARACTER PERSONAL
4.1. În vederea Prelucrării datelor cu caracter personal, Societatea are în vedere respectarea următoarelor principii:
(i) Prelucrarea cu bună-credință și în conformitate cu dispozițiile legale în vigoare a acestor date;
(ii) Prelucrarea datelor cu caracter personal se face în scopuri determinate, explicite și legitime, adecvate, pertinente și neexcesive prin raportare la scopul în care sunt colectate și ulterior prelucrate;
(iii) persoanele care Prelucrează datele cu caracter personal au primit instrucțiuni cu privire la modul de operare al acestora și sunt ținute de obligația de păstrare a confidențialității prelucrării acestor date;
(iv) În cazul identificării unor erori cu privire la datele cu caracter personal stocate, Societatea va face demersurile necesare în vederea îndreptării acestor erori;
(v) Datele cu caracter personal vor fi stocate pe perioada în care Persoana vizată este client/colaborator/abonat al Societății;
(vi) Informarea Persoanelor vizate de faptul că li se vor Prelucra datele cu caracter personal;
(vii) Persoanele vizate au dreptul de a notifica conform art. 9.1. Operatorul cu privire la orice Date cu caracter personal stocate sau cu privire la prezenta Politică;
(viii) Societatea va lua toate măsurile tehnice și organizatorice de securitate a Datelor cu caracter personal pentru protejarea acestor date împotriva distrugerii accidentale sau ilegale, pierderii, modificării, dezvăluirii sau accesului neautorizat;

6. SECURITATEA DATELOR CU CARACTER PERSONAL
6.1. Pentru a proteja Datele cu caracter personal de distrugerea accidentală sau ilegală, de pierderea sau alterarea acestora și de accesul unor persoane neautorizate, Societatea utilizează metode și tehnologii de securitate pentru a proteja Datele cu caracter personal colectate conform prevederilor legale în vigoare.
6.2. Societatea vor desemna persoana/persoanele care se vor ocupa cu Prelucrarea datelor cu caracter personal.
6.3. Orice modificare a Datelor cu caracter personal se poate face numai de către Persoanele vizate. Persoanelor vizate le-a fost adus la cunoștință faptul că Datele cu caracter personal care sunt prelucrate sunt confidențiale, precum și riscurile pe care le comportă Prelucrarea datelor cu caracter personal.
6.4. Datele cu caracter personal prelucrate și utilizate de către Societate se vor stoca pe suport electronic sau arhivă pe suport hârtie, pentru perioada necesară pentru realizarea scopurilor în care au fost colectate.

7. DREPTURILE PERSOANEI VIZATE
7.1. Persoanele vizate au următoarele drepturi:
(i) dreptul la informare - presupune posibilitatea Persoanei vizate de a solicita și obține de la Societatea care îi prelucrează Datele cu caracter personal confirmarea faptului că Societatea este cea care prelucrează aceste date;
(ii) dreptul de acces la Date cu caracter personal - presupune dreptul de a obține de la Societate care Prelucrează date cu caracter personal, la cerere, conform art. 9.1., și în mod gratuit, rectificarea, actualizarea, blocarea sau ștergerea Datelor cu caracter personal prelucrate de Societate, în special a datelor incomplete sau inexacte, pe baza actelor doveditoare;
(iii) dreptul de a solicita și obține modificarea Datelor cu caracter personal inexacte;
(iv) dreptul de opoziție –În orice moment, persoana vizată are dreptul de a se opune, din motive legate de situația particulară în care se află, prelucrării în temeiul articolului 6 alineatul (1) litera (e) sau (f) sau al articolului 6 alineatul (1) a datelor cu caracter personal care o privesc, inclusiv creării de profiluri pe baza respectivelor dispoziții.
(v) Dreptul la ștergerea datelor („dreptul de a fi uitat”)- Persoana vizată are dreptul de a obține din partea operatorului ștergerea datelor cu caracter personal care o privesc, fără întârzieri nejustificate, iar operatorul are obligația de a șterge datele cu caracter personal fără întârzieri nejustificate în cazul în care se aplică unul dintre următoarele motive: (a) datele cu caracter personal nu mai sunt necesare pentru îndeplinirea scopurilor pentru care au fost colectate sau prelucrate; (b) persoana vizată își retrage consimțământul;(c) persoana vizată se opune prelucrării; (d) datele cu caracter personal au fost prelucrate ilegal; (e) datele cu caracter personal trebuie șterse pentru respectarea unei obligații legale care revine operatorului în temeiul dreptului Uniunii sau al dreptului intern sub incidența căruia se află operatorul;
(vi) Dreptul la rectificare-Persoana vizată are dreptul de a obține de la operator, fără întârzieri nejustificate, rectificarea datelor cu caracter personal inexacte care o privesc. Ținându-se seama de scopurile în care au fost prelucrate datele, persoana vizată are dreptul de a obține completarea datelor cu caracter personal care sunt incomplete, inclusiv prin furnizarea unei declarații suplimentare.
(vii) Dreptul la restricționarea prelucrării - Persoana vizată are dreptul de a obține din partea operatorului restricționarea prelucrării în cazul în care se aplică unul din următoarele cazuri: (a) persoana vizată contestă exactitatea datelor, pentru o perioadă care îi permite operatorului să verifice exactitatea datelor; (b) prelucrarea este ilegală; (c) operatorul nu mai are nevoie de datele cu caracter personal în scopul prelucrării, dar persoana vizată i le solicită pentru constatarea, exercitarea sau apărarea unui drept în instanță; sau (d) persoana vizată s-a opus prelucrării.
(viii) Dreptul la portabilitatea datelor-Persoana vizată are dreptul de a primi datele cu caracter personal care o privesc și pe care le-a furnizat operatorului într-un format structurat, utilizat în mod curent și care poate fi citit automat și are dreptul de a transmite aceste date altui operator, fără obstacole din partea operatorului căruia i-au fost furnizate datele cu caracter personal.
7.2. Politica astfel modificată va fi publicată pe site-ul oficial, ,[www.lebadaresidence.ro] fiind transmisă prin e-mail către toți clienții.
7.3. Politica modificată va fi valabil aplicabilă începând cu data transmiterii ei către clienți.

8. TRANSFERUL IN STRĂINĂTATE A DATELOR CU CARACTER PERSONAL
8.1. Datele cu caracter personal ale persoanelor vizate prelucrate de Societate nu vor fi transferate în alte state.
